It is courtroom closure time for Sunny Hostin‘s son!
Gabriel Hostin’s legal troubles have officially come to an end after his trespassing citation was dismissed following his completion of a pre-arraignment diversion program.
This comes after Sunny Hostin, a former federal prosecutor and longtime “The View” co-host, defended her son following the trespassing incident. She had argued that Gabriel, a Harvard graduate with no criminal history, had made an innocent mistake while training.

Sunny wasted little time stepping in after her son, Gabriel Hostin, received a trespassing citation in New York. Rather than treating the matter as a situation that needed to play out in court, she wrote directly to the district attorney and made the case for having the citation dismissed.
In her letter, Hostin described Gabriel as “a 2025 Harvard University graduate with no criminal history or prior contact with the criminal justice system” and an “avid runner and former Junior Olympian track athlete who was in the area training.” She was using his background to explain why she believed the trespassing citation should not escalate into a criminal matter
The former federal prosecutor also explained that Gabriel had spotted a gravel incline that appeared suitable for hill training and had not noticed a nearby “No Trespassing” sign. With those circumstances in mind, Hostin’s initial position was clear: she wanted the case dropped rather than having her son face further legal consequences.
Gabriel Hostin Ultimately Took The Fresh Start Route
Gabriel’s case, however, did not end through the immediate dismissal his mother had requested. Prosecutors had reportedly offered him the Fresh Start program, a pre-arraignment diversion option designed to give eligible first-time, low-level offenders a chance to avoid criminal prosecution by completing specific requirements.
After initially insisting that the matter should be resolved with an immediate dismissal, Gabriel ultimately accepted the program and completed its required three-hour educational course on August 20. That decision gave the case a different resolution from the one Hostin had originally sought.
With the course completed, the trespassing citation is now being dismissed, bringing the legal matter to an end. TMZ reported that Gabriel completed Fresh Start, meaning the case ultimately reached the outcome his mother wanted, even though it took a different route to get there.
Sunny Hostin’s Police Encounter Added A New Twist To Gabriel Hostin’s Case
The police encounter provided another view of what happened that day. In the bodycam video, it showed Hostin speaking with officers after she arrived at the scene, during which she said she was trying to account for the reasons her son was near the railroad tracks.
The exchange also showed that Gabriel Hostin had been cooperative with officers during the encounter. Although Hostin pushed for understanding of the situation, authorities maintained that the location was an active railroad right-of-way and that entering the area was prohibited.
The Blast reported that the incident ultimately left Gabriel facing a trespassing citation despite his mother’s efforts to have the matter resolved immediately.
The footage also showed that officers had briefly placed Gabriel in handcuffs before Hostin arrived, while the conversation that followed captured her emphasizing her legal background and her son’s accomplishments.
Despite her appeal, officers explained that they could not simply ignore the violation, noting that the circumstances could have resulted in an arrest but were instead reduced to a trespassing citation.
Megyn Kelly Accused The Host Of Playing ‘The View’ Card
The police encounter did not end with the citation itself. Once the bodycam footage circulated, Megyn Kelly publicly criticized Sunny for identifying herself as a co-host of “The View” and a former federal prosecutor while speaking with the officers.
Kelly argued that no one should receive special treatment because of their professional background or connections. She took particular issue with Hostin mentioning her position on the ABC show and Gabriel Hostin’s Harvard education while asking police not to issue the citation.
The journalist described the exchange as “dripping sanctimony and hypocrisy” and argued that “no one is above the law.”

While the outcome of Gabriel Hostin’s case has now brought the legal chapter closer to an end, Hostin has previously opened up about a much more personal side of being a mother.
In a 2024 interview with Us Weekly, the television personality reflected on raising Gabriel and her daughter, Paloma, and admitted there was one thing she wished she had done more often. She said she would have taken more pictures and videos and reminded herself to “cherish every single second,” especially as she watched her children grow older.
Hostin also acknowledged that the transition toward becoming an empty nester was difficult, admitting that she would miss having her children at home. “The hardest part is watching them fly,” she said, while adding that if she had done her job as a mother, they would “fly and soar.”
