One year after Malcolm-Jamal Warner‘s tragic death, his family is now at the center of a legal dispute. The actor’s widow, Tenisha Warner, filed a lawsuit against the actor’s mother, Pamela Warner, over a prenuptial agreement that had not been fulfilled. Tenisha claims she attempted to settle the matter privately to no avail, thus prompting her to take legal action.
Malcolm-Jamal Warner passed away on July 20, 2025, leaving behind his wife, Tenisha, and their young daughter. Exactly a year after the actor’s drowning death, his widow filed a lawsuit against Warner’s mother, Pamela Warner, who was the actor’s manager.
In the lawsuit, filed in Decatur, Georgia, on July 20, Tenisha claimed she is owed $1.2 million, citing a prenuptial agreement they signed.
In a statement, Warner’s widow said the actor “had every intention to provide” for her and their daughter.
“He was close to finalizing a new estate plan to replace the stale plan he created in 1996 when he was 26 years old, 20 years before we met and well before we gave birth our beautiful daughter. Sadly, he was unable to do so before we lost him,” Tenisha said, as reported by ABC News.
Tenisha Warner Details Terms Of Prenuptial Agreement
The lawsuit is against Pamela, who is named as a “successor trustee of the Warner family trust.” The prenuptial agreement was also attached to the filing.
The suit noted that Warner agreed to purchase and maintain a $1 million life insurance policy under his name with Tenisha as the beneficiary, but he failed to do so. The actor also agreed to pay his wife $16,000 annually on their wedding anniversary, and his widow claims she is owed more than $50,000.
Additionally, Tenisha alleges Warner did not maintain her Roth IRA during their marriage as agreed upon and failed to give her the promised salary of $5,000 monthly for working as his assistant and chief of staff.
“In total, the amounts due and owing to Plaintiff under the Agreement total no less than $1,276,042.46,” the lawsuit read, per CNN.
Tenisha Warner Attempted To Settle The Dispute Privately
Warner’s widow said that for the past year, she had been attempting to settle the prenuptial dispute out of court but was unsuccessful. She has chosen to take legal action in an attempt to get what she claims she is owed.
“I have been struggling to care for our daughter as a single mom and now as her sole provider. Legally, I had no choice but to take action to protect our rights before any potential statute of limitations expired,” Tenisha said in her statement.
Warner’s mother, Pamela, has not publicly responded to the lawsuit.

Warner rose to fame in 1984 when he was cast as Theo Huxtable on the sitcom “The Cosby Show.” He also appeared in major roles on shows such as “Malcolm & Eddie,” “The Resident,” “Read Between the Lines,” and “Jeremiah,” and had recurring roles in “Community,” “Suits,” “Sons of Anarchy,” and “American Horror Story: Freak Show.”
In July 2025, Warner was on vacation with his family in Costa Rica when he was caught in a rip current while swimming at Playa Grande. A lifeguard and a surfer managed to pull the actor from the undertow, but he had no vital signs when they reached the shore. His cause of death was officially ruled as accidental asphyxia by submersion. He was 54 years old.
A couple of months after the accident, Pamela spoke to ABC News and said Warner was in waist-deep or chest-deep water. “There was an undertow and my son was not an experienced swimmer. He did not know how to deal with an undertow,” she said.
Pamela Honored His Son On His First Death Anniversary
On July 20, Pamela took to Instagram and shared photos of his son, accompanied by a touching message for his first death anniversary. She reflected on the past year and shared her grief and realizations.
“I was chosen and blessed to be the mother a child who embodied brilliance, creativity, intelligence, empathy, a love for his people, confidence, and belief that we can all be ‘better us’s’ as Malcolm would say,” Pamela wrote.
